TERMS OF SERVICES
First of all, thank you so much for being interested in commissioning me. Before submitting your commission request, please carefully read and take a look at the following terms and services/guidelines.The following terms of service are strictly for non-commercial and personal work. Any commercial contracts will not be provided at this time.By purchasing a commission from me, you agree to the following terms between you the client, and I the artist. I. ARTIST
-------------------------------------------------------------------------
- I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities.- I retain original copyright and ownership of the work, including but not limited to redistributing, reproducing, advertising, and displaying the work on my websites, social media, and portfolios, according to my discretion. I have the right to repurpose unused process work for future projects, personal or otherwise.- I, the artist, retain the property of all preparation material, visuals, sketches, including all electronic/digital files used to create the commission.- I, the artist, reserve the right to edit, sell, post and/or distribute any unpaid, cancelled or abandoned commissions by the client by breaking my Terms of Services. To elaborate, this means I have the right to use the concept, pose, color palette for other works. [Your original character will not be tampered or used in any way and will be replaced by another character.]- While working for the client and after, I do not have copyright over the client’s character(s), design(s) or original concept(s).-------------------------------------------------------------------------
II. Client
-------------------------------------------------------------------------- You, the client, are of legal age. By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed.- You, the client, are granted exclusive rights for "PERSONAL USE" of the work produced as agreed upon, which must not be transferred to other parties.- You, the client, by commissioning me you confirm that you have read and agree to follow the entirety of these terms of service.-------------------------------------------------------------------------
III. Content
-------------------------------------------------------------------------- I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities.
Please read the following lists to be aware of what I can draw and cannot.CAN draw:
- Humans/Humanoids [Non-human but with human characteristics]
- Chibis
- NSFW [Includes violence/blood, gore, injuries, suggestive]
(Please do note that if it is too controversial, I may not be able to draw it excessively.)======CANNOT draw:
- Explicit pornographic NSFW
- Extremely muscular body types
(Practicing – May be included in CAN draw in the future)
- Mechas
- Animals (depending on what it is)
- Other artstyles.
- Gender identities and cultures I feel I may not be able to accurately or authentically portray or represent well.For any other concept that is not listed, please send a reference for confirmation and for whether I can proceed with your commission request or not.-------------------------------------------------------------------------
IV. Payments / Refunds
-------------------------------------------------------------------------- I accept payments through Ko-fi (paypal via Ko-fi)- Do not send any payment before I have agreed to do your commission.- All payments are paid upfront 100%.- I will not begin work on the commission before I receive payment.- Once paid and commissioned, you lose the rights to a refund. Once again, there are no refunds once I start working on your commission. If you believe that you may need your money for other purposes, please do not commission me and think before paying.- If a commission is cancelled due to the client’s inability to comply and follow any of the terms of service or rules, the artist reserves the right to cancel the project without any refunds.==========ADD-ONS (IN KO-FI COMMISSION OPTIONS)- If you do not check the add-ons like for the backgrounds, and you wrote down a background in your reference/what you want me to draw, I will NOT include it, so make sure to check the box!-If you select everything such as checking the half body and full body together, or checking all the backgrounds, or checking all the additional character options, that is INCORRECT.- I WILL NOT DO REFUNDS, EVEN FOR ACCIDENTAL PAYMENTS (like checking contradictory boxes/add-ons. E.g. Checking the half-body and full body add-on together even though you are only asking for full-body.)SO PLEASE I KINDLY ASK YOU TO READ THE INSTRUCTIONS AND CHOOSE CAREFULLY.-------------------------------------------------------------------------
V. Deadlines
-------------------------------------------------------------------------- Make sure to have read [I. Artist].- As of the moment, I do not accept RUSH ORDERS- Depending on which commission you’ve chosen, it will have different delivery days.- There is a maximum of 3 months for the artwork/commission to be delivered.- Depending on the amount of commissions and other factors such as my health, family, living conditions, and/or the complexity of your commission, there may be possible changes to the deadline depending on the circumstances.- I will ALWAYS inform you in any case of an emergency or life event that may delay your commission being finished. So with that, make sure to check your messages/email for updates.- I follow a [4 Stages of Communication] Process. Check VIII. for more details. This means that depending on how long the client responds to the wips, checks and messages, it will affect the deadline. If client does not respond, artist is not responsible for longer deadline or incompletion of the commission.-------------------------------------------------------------------------
VI. COPYRIGHT & USAGE POLICY
-------------------------------------------------------------------------- You, the client, are allowed to print the images yourself for your personal use.- You reserve the right to repost and share the commissioned work after it is completed with credit.- You, the client, may use the commissioned work as a profile picture/icon.- You, the client, have the right to give it as a gift for friends and family.- Do not trace or heavily reference my work without permission.- Do not remove watermarks from my work.- All my commissions may NOT be used for NFTs and NFT related projects.- All my commissions may NOT be used for AI training/development and AI related projects.- All my commissions may NOT be used for any ML (Machine learning) tools, programs, and platforms.- All my commissions may NOT be used for blockchain or other forms of profit.-------------------------------------------------------------------------
VII. COMMERCIAL USE
-------------------------------------------------------------------------- As of the moment, I am not accepting commissions where you, the client, will use it for commercial use.Commercial use is any reproduction or purpose that is marketed, promoted, or sold and incorporates a financial transaction from my artwork. When purchasing a commercial commission from me, you are also buying the rights to use my artwork for your product. What I can draw and cannot draw still applies in this.-------------------------------------------------------------------------
VIII. PROCESS/TIMELINE/WORK STAGES
-------------------------------------------------------------------------- Artist will only be referring to the references that you have sent. Any major references sent after the 2ND WIP stage will not be considered and will be disregarded.- WIPs will and are always watermarked and the commissioner has no rights to any WIPs given during the process or in any cases of cancellation.=====PROCESS: 4 STAGES OF COMMUNICATION[PLEASE MAKE SURE YOU ARE ABLE TO BE CONTACTED VIA GMAIL / KO-FI MESSAGES]

2. Clean up + Flat Colors + Second Approval. – [JPEG files]
- Please make the major revisions and adjustments during this stage. You can make at least 3 revisions. I will not be doing any more adjustments in the further stages.- You may tell me to change any of the colors for free if you are not satisfied with the hue, shading or saturation. You may even send me a picture of the colors you want or the color codes.- You are not allowed to send any updated references unless it’s only a small revision such as small accessories [Necklaces, earrings, bracelets, other types of small accessories.)

3. Full render for final approval.- Note that you will NOT be able to ask for ANY revisions or adjustments during this stage.- You may ask for any minor finishing touches.

4. After completion, the final digital file [PNG] will be delivered to you via Ko-fi/gmail.A full-resolution image + 300 DPI file. Note that there is no physical product to be delivered or shipped to the client.
If the artist is the one to fail and not add a major detail/s in the commission, the artist will revise the commission for free.-------------------------------------------------------------------------
IX. Communication
-------------------------------------------------------------------------- The client agrees to maintain timely and open communication with the artist throughout the project. This includes reviewing and responding to sketches, drafts, or work-in-progress updates sent by the artist.- While the artist will make every effort to respond promptly, clients should not expect instant replies. Response times may vary due to real-life obligations, time zone differences, or other projects. Delays in artist responses do not affect the client’s responsibility to provide feedback. (I will do my best to reply within 72 hours).- If the client does not respond to updates or requests for approval, the artist is not responsible for delays in the project timeline. Lack of client response does not entitle the client to a refund.- Please note that all communications/messages/conversations regarding the commission will be used as evidence. In other words, there are screenshots, video recordings, etc of the communications. This is a protective system in the case of conflicts. Understand that I am a human first and an artist second.-------------------------------------------------------------------------
X. AGREEMENT
-------------------------------------------------------------------------- The date for this agreement is upon the first transaction made, in other words, the payment or checkout.------------------------I have the right to retain screenshots of the commission conversation as a protective system in the case of slanderous remarks. By commissioning and messaging me, you are agreeing to my terms and will accept the enforced penalties if you fail to follow through. Penalties include: cancellations, no refunds, black listing, and artists beware post. The refusal of refunds is only applicable if the commission experience is incredibly deplorable due to your behavior. Understand that I am a human first and an artist second. I have the right to refuse to work with anyone who talks down to me, treats me poorly, makes me uncomfortable, sexualizes, or objectifies me. If I choose to take a penalizing action, I will send a courtesy message explaining what led to the cancellation and any other action. As a protective measure, I will screenshot evidence and the courtesy message to justify slander.
